Mistrial for Andrews – Jury Can’t Decide Guilt

In Cumberland County, a judge declared a mistrial in the death penalty case of Mark Leon Andrews after jurors were unable to unanimously decide whether he was guilty.  Andrews was accused of shooting Boyd Lamont Constant in 2006 after learning that Constant had allegedly molested one of Andrews’ relatives.  The defense argued that one of the witnesses against Andrews, who had previously been convicted of murder and was running a drug operation out of the victim’s home, was the actual killer.  Three jurors voted to find Andrews not guilty while nine voted to convict.  Prosecutors have indicated that they plan to retry the case.
