New Trial for Death Row Inmate Johnny Burr

A United States Magistrate Judge has recommended that Johnny Burr, who has been on North Carolina’s death row since 1993, receive a new trial.

Burr was convicted of the 1991 murder of four-month-old Susie O’Daniel in Alamance County.  Judge Trevor Sharp has ordered a new trial due to evidence that O’Daniel was not murdered at all; instead she died as the result of an accident in which Burr was not even involved.

    WE JOHNNY BURR’S FAMILY NOW HAVE HOPE AGAIN THANK TO JUDGE TREVOR SHARP AFTER LOSING FAITH IN THE COURT SYSTEM.THE PERSON WHOM THEY SAID DID ALL THEM THINGS IS NOT OUR BROTHER FOR JOHNNY IS A CARING PERSON OF EVERYTHING ON THIS EARTH. HE HAS A GRAT BIG HEART.

    I OPPOSE THE DEATHPENALTY, AND THIS CASE IS A JUST A VIVID REMINDER AS TO WHY I DO.. WHEN I SAW THIS ARTICLE I WAS 1ST SO RELIEVED FOR THIS MAN, AND 2ND IN SHOCK THAT HE IS FINALLY GRANTED ANOTHER TRIAL, AND THEN REMINDED OF WHY I OPPOSE THE DEATH PENALTY. AS A CHRISTIAN, A HUMAN, AND AN AMERICAN I BELIEVE IN JUSTICE FOR ALL. THIS HOWEVER DOES NO JUSTICE FOR ANYONE AT ALL. IF U THINK ITS JUSTIFIABLE THAT HES FINALLY GETTIN A NEW TRIAL AND MAY BE ABLE TO WALK OUT A FREE MAN, THEN THINK AGAIN. HIS MIND WILL CONTINUE TO BE A PRISION FOR THE REMAINDER OF HIS LIFE. THIS MAN PLEADED HIS INNOCENCE TO THE HOSPITAL, POLICE, DETECTIVES, A JURY, A JUDGE, THE PUBLIC, THE PRISON, THE THE FAMILY, AND MAINLY P U B L I C .. AND CAN U IMAGINE BEING THIS MAN AND BEING ACCUSED OF SUCH A HORRIFIC ACT OF MURDER ON THIS 4 MONTH OLD CHILD (WHO IM PRESUMING WAS NOT HIS) AND WE ALL KHAVE HEARD IT SAID THAT CHILD MOLESTERS GET “SPECIAL TREATMENT” BY INMATES. OR THE KNOWING YOUYR INNOCENT AND PLKEADING TO BE HEARD AND BELIEVD? IM THANKFUL TO GOD AND THIS JUDGE FOR FREEING HIM, AS I KNOW HE WILL BE FREED EVENTUALLY. THANK YOU GOD & MR.     I’m am glad to hear that johny is getting a new trial> i have been writing to him for a short time & he seems to be a dear man with a good heart & a terrible injustice has been done to him. I continue to lift him & his family up in prayer that justice might finally be done in his case.

  6. I remember this very well. There was evidence that was never allowed to be presented (medical records, social services reports etc.)He didn’t get a fair trial. I hope he does get out soon.

    The mother of the little girl had older children who would pick this baby up, drop her, etc.(no wondered she was injured!) The mom got pissed at John for whatever reason and blamed it on him. I can say this now and I will. I worked for his defense attorney when this was going on. There was a LOT of evidence from Social Services, etc. the judge never allowed. (Maybe he had to get home to dinner) Who knows?? I remember John calling me wanting to talk to his attorney (who I worked for at that time), he (John) had so much sorrow and stress in his voice, I felt bad for him. He does not deserve to be in prison another day for this!!!!

  8. You have no clue what you are talking about…I’ve seen the pictures of Susie and as a matter of fact, I was married to one of the “older children”. You don’t know what that family went through and still goes through daily! He’s a murderer and always will be one. God help him if he ever gets out…

      This man has a very kind heart. He was in the wrong place at the wrong time. He has been around children all his life and has never, ever layed a hand on one of them. He loved his nieces, nephews, and especially his own children. He is a great father, brother, friend, and uncle. I know because he is my uncle. He deserves another trial. So much has come out into the open since he was convicted. He is NOT a murderer and God will help him when he gets out. I am sorry for this family’s loss but Johnny does not deserve to lose his life for something he did not do. Some people are really blind to the truth, but it will come out sooner or later.
